EPA Releases Instructions for Submitting Data for New Chemicals under TSCA
In late April, EPA published information intended to help companies comply with the agency’s recent final rule on the review of new chemicals under the Toxic Substances Control Act (TSCA). The rule, which was published in the Federal Register in December 2024, requires EPA to make formal determinations of safety for every new chemical that manufacturers submit to the agency for approval and specifies the data submitters are required to provide.
The system companies use to submit data to EPA is known as the Central Data Exchange, or CDX. Upgrades to CDX were under way when the December 2024 rule was finalized and are not yet complete. The new information from the agency describes how companies can meet the data requirements of the new rule for the submission of pre-manufacturing notices (PMNs) while work continues on CDX. The agency did not indicate when the upgrades are expected to be completed.
